General Terms and Conditions for the Use
of Linen2GO for Consumers


1.
Conclusion of Contract - Scope

1.1. These General Terms and Conditions ("GTC‑Consumer") shall apply between Linen2GO Austria GmbH, (companies registry number 594096x; hereinafter referred to as "L2G") and the customer ("User") for all business relationships, especially for the order placement and unassisted collection of rental laundry from a self-service station ("Service-Box"). These GTCs shall apply exclusively unless expressly superseded by another agreement.

2. General Provisions

2.1. Users shall register for the use of L2G services and the use of the Service Boxes via the app and create a user account ("User‑Account"). Consent to these GTCs for Consumers and the privacy policy is a prerequisite for the registration. Creation of a User Account does not entitle the user to conclude any rental agreement with L2G.

2.2. For the registration, User must provide accurate and genuine personal data. Furthermore, a valid credit or debit card must be provided as a payment method as well.

2.3. If the data provided changes after registration, User shall update any and all information without delay.

2.4. Users must protect their user accounts against access of unauthorized third parties. If there is suspicion of misuse of their user account by unauthorized third parties, users shall inform L2G without delay.

2.5. L2G reserves the right to delete User account which has not been completely created after a reasonable period of time. The same applies to User Accounts which have not been used for an extended period of time (more than 12 months). Before deleting any such account, L2G shall inform the User.

2.6. In the course of the use of Service‑Boxes, L2G processes information of Users, including personal data. This includes, in particular, information which Users disclose to L2G. After termination of the agreement with the user, data provided by the respective User or generated by their use will be deleted. Except in cases where L2G needs to store any such information after the termination of the contract to fulfill legal obligations or due to other legitimate interests. Aggregated data generated by use (e.g., statistics) are generally also stored after the end of the contract (see privacy policy).

3. Group-User-Accounts

3.1. Users have the option to use a registered user account collectively with multiple users ("Group-User-Account"). Each user can invite other users to use their user account as an administrator ("Group‑ Administrator").

3.2. Group‑Administrators need to set up a valid group payment method for all users of a Group‑User‑Account, which can be used for payments for L2G services. Group‑Administrators are responsible for all activities, especially orders, contract conclusions, and payments, of users of their Group‑User‑Account and are informed about all activities of the users.

3.3. If an individual user account or the Group-User-Account is deleted, outstanding orders or costs for ongoing rental contracts may be charged to the Group‑Administrator.

3.4. Group‑Administrators shall delete accounts of inactive users of the Group‑User‑Account (due to terminations or other reasons).

4. Availability of rental laundry quantities, duration of use, return after expiry of the deadline

4.1. In general, quantities of only up to 500 laundry items shall be issued to Users who are consumers. Quantities exceeding this number can be made available only by individual written agreement.

4.2. Users shall be informed that laundry can only be picked-up from a Service‑Box for a maximum of three times in a row without also returning used laundry during this period. At the latest on the fourth pick-up, used laundry must be returned in the amount of 33% of the items taken in total. Only afterwards clean laundry may be taken from the Service‑Box again. This measure shall ensure the general principle of laundry rental and a profitable circulation of laundry.

4.3. L2G shall make an effort to equip LG2 Service‑Boxes with sufficient laundry. L2G assumes no liability or guarantee that sufficient laundry is available for all Users at all times.

4.4. User shall be obligated to return each rental laundry item to L2G. The listed prices are flat rates and include service costs, cleaning costs, and rental fees and are charged for a rental period of 16 days.

4.5. In the case that the rental laundry items are not returned after the expiry of the 16-day rental period, L2G shall charge a rental fee of EUR 0.60 for small items (cushion cover, towel, bath mat, bath towel) and EUR 1.37 for large items (blanket cover and fitted sheet) for each starting week. Such rental fees shall be charged to User, until the replacement price of such rental laundry item is fully reached.

 

5. Prices and Price Discounts/Corrections - Payment Method - Default

5.1. L2G reserves the right to change the prices for the items displayed on the website or on the L2G app at any time and to correct any accidental errors in pricing. Any price change shall not affect the prices of rental laundry already in possession of User.

5.2. All prices stated on the website or in the L2G app are in EUR including the statutory value-added tax.

5.3. The user shall pay a monthly service fee of EUR 5.99 for the use of the User account. This fee shall be charged for each month in which the User actively uses the Service‑Box for at least one day by renting rental laundry.

5.4. Payment is accepted exclusively via credit and debit card.

5.5. The User's account/credit/debit card shall be charged when the amount of picked-up rental laundry is confirmed by User. L2G verifies the User's data provided and the credit rating of the user if necessary by means of data comparison and/or a query with a corresponding service provider. If the customer's credit card or the specified payment method cannot be charged, the customer will be asked to provide another, valid payment method. If no valid payment method is provided, the customer will not be able to borrow rental laundry. The customer is requested to return any and all picked-up rental laundry items to the Service Box without delay.

5.6. If a User is in default of payment, L2G is entitled to demand default interests of 5% p.a.

 

6. Recording of Entrances

6.1. User acknowledges that the Service Box is video‑monitored, and the entrances are recorded. The details of data processing can be found in the privacy policy.

 

7. Termination of the Agreement

7.1. If User still has laundry items in possession at the time of the termination of the agreement, User shall return any and all rental laundry to L2G within the specified time, but no later than within 16 days after the termination.

7.2. If the rental laundry is not returned to L2G upon termination of the agreement completely, L2G may charge the User for any and all such rental laundry in the User's possession with applicable replacement price.

 

8. Warranty for Defects

8.1. L2G provides rental laundry  for User to pick‑up from the Service‑Box. Before using the rental laundry, User shall inspect the rental laundry for defects. If the User detects a defect (stains, damages) before use, they must return the defective rental laundry unused to the Service‑Box at the latest within 16 days. Any and all such claimed laundry item shall be inspected as well by L2G. In the event that the claim is justified due to inspection of L2G, the charged price for the claimed rental laundry shall be returned to the User as a credit at the next pick-up visit at the Service‑Box. If no such claim is made within 16 days, the picked-up rental laundry or any such item shall be deemed to have been free from defects.

8.2. User must use the rental laundry carefully and appropriately. L2G reserves the right to charge the customer for excessively soiled or misused rental laundry at the replacement price.

 

9. Liability for Damages

9.1. L2G shall not be liable, in particular, for non-specific, general  product‑related information and recommendations given free of charge or for hyperlinks referring to third-party offers.

9.2. User shall warrant that no unauthorized third party gains access to their User data or User‑Account. User shall be liable for any and all unauthorized use of the Service‑Box due to lack of protection of their own User‑Account.

 

10. Retention of title

10.1. L2G retains legal ownership of any and all rental laundry (Eigentumsvorbehalt).

10.2. User shall be obliged to protect the rental laundry against unauthorized use by third parties and especially against damage or destruction.

 

11. Product Availability and Restrictions

11.1 The quantities and the range of offered rental laundry may vary depending on seasonal availability or capacity. L2G reserves the right to change the quantities and range of rental laundry at any time.

 

12. Severability clause

12.1. If one or more provisions of these GTCs for Consumers are or become invalid, this shall not affect the validity of the remaining provisions. Invalid provisions shall be replaced by valid provisions that come as close as possible to the intended economic purpose.

 

13. Applicable Law and Jurisdiction

13.1. Austrian law shall apply for any and all business relationship. The applicability of the UN Sales Convention and the reference rules (IPRG, EVÜ) shall be excluded.

13.2. In case of disputes only the German version of these GTCs for Corporate-Customers shall prevail.

14. Information regarding Data Protection

14.1. The L2G Privacy Policy describes in detail how personal data is processed and what measures are taken to protect personal data. Personal data is processed for the purpose of conducting business with User and is disclosed to third parties (such as payment service providers) solely for this purpose. Users are entitled to prohibit the transfer of personal data at any time. L2G stores personal data and informs the consumers via email together with these GTAs. These GTAs may be viewed at any time via www.linen2go.at. The order data may be viewed in the User-Account.
